The U.S. International Trade Commission did not review a preliminary ruling made by one of its judges in March and subsequently dismissed Masimo's lawsuit. The preliminary ruling found that Apple's redesigned Apple Watch did not infringe on Masimo's patents related to blood oxygen monitoring technology. Masimo, which is part of the Danaher Corporation, can appeal to the U.S. Court of Appeals for the Federal Circuit located in Washington. A spokesperson for Masimo declined to comment on the ruling. Apple stated, "We appreciate the ruling from the U.S. International Trade Commission, which ensures that we can continue to provide this important health feature to our users. For more than six years, Masimo has launched relentless legal actions against Apple, with nearly all of its claims being dismissed." Masimo previously accused Apple of poaching its employees and stealing technology for pulse oximeters used to detect blood oxygen levels, leading to a protracted legal dispute between the two companies. In December 2023, the U.S. International Trade Commission found that Apple's Series 9 and Ultra 2 smartwatches infringed on Masimo's patents and prohibited their import. To circumvent the ban, Apple temporarily removed the blood oxygen monitoring feature from the watches and later reintroduced an upgraded version of the technology in August of last year, with approval from U.S. Customs and Border Protection. The upgraded watches no longer directly display health data from the pulse oximeter but present it on associated Apple devices like the iPhone; the original Apple Watch can directly display the relevant data. Additionally, Masimo has separately filed a lawsuit against Customs regarding the approval of the revised watch imports. Masimo is also suing Apple for patent infringement and theft of trade secrets in the U.S. District Court for California, and won a judgment in November's patent trial, receiving $634 million in damages.
