# The jury selection for the Musk vs. Ultraman case officially begins

This major lawsuit of **Musk vs. Altman**, where former friends have turned adversaries and now have conflicting interests, has officially initiated the jury selection process in the federal court in Oakland, California.

The case is presided over by Judge Yvonne Gonzalez Rogers, with the trial starting this Monday. The parties involved are the world's richest man, Musk, and the CEO of OpenAI, Altman. According to court documents submitted in March, this trial will select 9 official jurors, **with no alternate jurors**. Musk co-founded OpenAI in 2015 and filed a lawsuit against the company, Altman, and President Greg Brockman in 2024.

Musk accuses the two of violating founding commitments: abandoning the organization's non-profit nature and deviating from its public mission. OpenAI has repeatedly rebutted, stating that Musk's lawsuit is **baseless**. Musk had already resigned from the OpenAI board in 2018; five years later, he founded a competing AI company, xAI, and merged xAI with Space Exploration Technologies Corp earlier this year.

During the litigation process, Musk has made several demands, including the removal of Altman and Brockman from all positions at OpenAI.

His lawyer claimed in January that the defendants had made improper profits of up to **$1.34 trillion**, and Musk is entitled to reclaim that amount; subsequently, Musk also proposed to reinvest this compensation into OpenAI's public welfare system.

Judge Gonzalez Rogers has divided the case into two major phases:

The first phase is the **liability determination phase**, which will determine whether the defendants have engaged in any violations or illegal activities; the second phase is the **remedial compensation phase**, which will decide the amount of compensation and subsequent rectification plans.

The jury will only participate in the first phase of liability determination, and their verdict will only serve as a reference; the final judgment for both phases of the case will be determined by the judge.

The judge stated on Monday that the liability determination phase is expected to be completed by May 21.

At the beginning of the trial, the judge welcomed the prospective jurors, introducing the case background and trial schedule in a light-hearted manner, and sequentially inquired about the jurors' personal views on Musk and the AI industry.

Altman and Brockman personally appeared in court on Monday to respond to the lawsuit.

In the complaint, Musk claims that OpenAI, Altman, and Brockman have long **deliberately induced and intentionally deceived** him.

In the early days of the founding, the other party promised to create a safer and more open AI organization compared to profit-driven tech giants, but has now completely violated that agreement. Musk is requesting the court to overturn OpenAI's recent restructuring plan — which established the core model of "non-profit parent holding profit-making subsidiaries." On the eve of the trial, Musk and Altman have been publicly sparring for months.

On Monday, Musk posted on the X platform, directly stating: "The fraudster Altman and Greg Brockman have stolen from the nonprofit organization, and the facts are undeniable."

In response, the official account of OpenAI immediately posted:

"We look forward to presenting the facts and legal principles in court to restore the truth. This lawsuit is baseless, purely an act of jealousy, aimed solely at suppressing competitors."

Musk initially filed 26 lawsuits in 2024, but currently retains only two: **unjust enrichment** and violation of fiduciary duty.

According to court documents, to streamline the case process and ensure trial efficiency, Musk's lawyers voluntarily withdrew the charges of fraud and presumed fraud.

The case coincides with a critical juncture:

Musk's SpaceX is about to initiate its IPO, expected to break global fundraising records; OpenAI also plans to enter the capital market later this year. The combined valuation of the two companies in the private equity market has exceeded **$2 trillion**
