# Uber Stock Rises Despite $966 Million Fine from Dutch Regulators

Shares of Uber (UBER) are rising today even though the ride-hailing company faces an €825 million ($966 million) fine. This comes after the Dutch Data Protection Authority ruled that Uber improperly used automated systems to suspend some drivers by not providing enough human review and by failing to properly explain some decisions. According to *Reuters*, the penalty would be the second-largest ever issued under Europe's GDPR privacy rules. Uber strongly disagrees with the decision and plans to appeal.

Interestingly, the case covers incidents between 2020 and 2022. During that period, Uber's systems sometimes suspended drivers after detecting possible fraud. For example, the system could flag a driver if it believed the driver took unnecessary detours to increase a fare. It could also flag someone who accepted trips without intending to complete them.

The problem is that European privacy law places limits on major decisions made entirely by computer systems. If an automated decision can seriously affect someone's life or job, regulators generally require meaningful human review. People must also have a way to challenge the decision. Dutch regulators concluded that Uber did not meet those requirements in some cases.

Unsurprisingly, Uber disputes that finding. The company says that temporary suspensions were generally short. It also says that permanent fraud-related account removals required human review. Uber added that its current policies allow drivers to dispute suspensions. In addition, since Uber plans to appeal, the $966 million headline number may not end up being the company's final cost.

## **Why the Size of the Fine Stands Out**

Nevertheless, Uber argues that the penalty is far too large compared with the number of drivers affected. The company says that only 126 European drivers were deactivated because of low customer ratings in 2021. Uber also denies that permanent deactivations were ever fully automated. The size of the penalty also stands out historically because only Meta Platforms' (META) €1.2 billion GDPR fine from 2023 has been larger. Meta is appealing that decision as well.

Still, major European fines against U.S. technology companies can take years in court, and some have eventually been reduced or overturned. Therefore, investors should not automatically assume Uber will ultimately pay the full amount.

Turning to Wall Street, analysts have a Strong Buy consensus rating on UBER stock based on 29 Buys, three Holds, and zero Sells assigned in the past three months, as indicated by the graphic below.
