# Spain's antitrust regulator stated that Apple and Amazon took too long to rectify anti-competitive contracts

Spain's antitrust regulator ruled on Wednesday that Apple and Amazon were previously required to immediately remove anti-competitive clauses from their contracts, but the two companies delayed execution for too long. These clauses defined the cooperation conditions for Amazon as Apple's distributor.

The Spanish National Commission on Markets and Competition (CNMC) had imposed a total fine of €194 million (approximately $228 million) on the two companies in July 2023, arguing that these clauses unfairly limited the number of authorized Apple distributors on the Spanish Amazon website and demanded the immediate removal of the relevant clauses.

The latest identified violations could lead to the two companies facing fines again.

The regulator also accused these clauses of restricting the advertising placement of competitors' products on the Spanish Amazon website and preventing Amazon from marketing other competing brands to Apple users.

In October of last year, the regulator proposed to initiate a new round of investigation because the two companies did not remove the relevant clauses until May 2025, failing to take timely action as required by the cease-and-desist order.

The regulator stated at the time that there was already evidence indicating violations by the two companies.

The two companies have appealed the CNMC's 2023 penalty decision to the country's High Court, and the original fine has been suspended pending the ruling
