Arch Capital Group Ltd. believes it was not a Passive Foreign Investment Company (PFIC) for any taxable year ended on or before December 31, 2025, and does not expect to become one for any subsequent taxable year . Its non-U.S. subsidiaries are expected to satisfy the RPII 20% gross income exception, meaning no U.S. shareholder is expected to include RPII in income . The adoption of new tax laws, including an “under-taxed profit rule” and a corporate income tax regime in Bermuda, is anticipated to increase Arch Capital Group Ltd.’s effective tax rate and aggregate tax liability .
