# US investigators confirm a Tesla vehicle using FSD function hit and killed a pedestrian

Authorities in Washington state, USA, said on Tuesday that they have confirmed that a Tesla car that struck and killed a motorcyclist near Seattle in April this year was operating in FSD mode at the time of the accident. Investigators confirmed this fact after downloading information from the event data recorder on this 2022 Tesla Model S. The driver involved in the accident has been arrested, "for admitting that he was not paying attention while driving in FSD mode and was distracted using his phone while moving forward, believing that the machine would drive for him." A spokesperson for the Washington State Highway Patrol said that there are currently no charges against Tesla
