</figure><p>The White House today released an outline of President Biden’s budget proposal for fiscal year 2022. The $1.5 trillion spending proposal includes sweeping increases in domestic spending initiatives including more funding for education, border security, and combatting climate change. The proposal includes an overall 16% increase in domestic spending.</p><div></div><p>Biden’s budget proposal specifically increases funding for higher education, with $102.8 billion allocated to the Department of Education, a $29.8 billion or 41 percent increase over the 2021. The increased funding for higher education will include $3 billion in Pell Grants and expanded eligibility for Dreamers, as well as an increase to the Pell Grant award limit. </p><p>The proposal also includes increases in funding for Historically Black Colleges and Universities, Tribally Controlled Colleges and Universities and other Minority-Serving Institutions. And it proposes a $100 million increase in funding for programs that aim to increase participation in science and engineering of individuals from racial and ethnic groups.</p><div></div><p>But not included in the President’s budget proposal is broad student loan forgiveness. Biden has publicly supported the idea of widespread student loan forgiveness, and he has repeatedly emphasized his preference that Congress enact student debt cancellation through legislation. White House Press Secretary Jen Psaki recently reiterated earlier this week that if Congress would pass a student loan forgiveness bill, Biden would gladly sign it. So why did Biden exclude student loan forgiveness from the budget proposal?</p><h2>Biden May Want Separate, Stand-Alone Student Loan Forgiveness Legislation</h2><p>Despite his ongoing stated support, Biden also did not include student loan forgiveness in the American Rescue Plan (the recent stimulus package he signed into law). The administration had suggested then that the White House preferred that student loan forgiveness be part of separate student loan reform legislation. That may also be why Biden excluded student loan forgiveness in the budget proposal, as well.</p><div><div id="recirc-unit"><div>MORE FOR YOU</div><div><div>This Just Made The Path To Student Loan Forgiveness Harder — And Increases Pressure On Biden</div><div>Student Loan Forgiveness Review Could Lead To Student Loan Cancellation, But There’s One Problem</div><div>Student Loan Cancellation Could Get You Student Loan Forgiveness, But Completely Ignores This Major Problem</div></div></div></div><p>Separate, stand-alone student loan reform legislation could be an attractive route for lawmakers given the broad array of student loan relief bills that were introduced in the 2019-2020 Congress. There were proposals to reform and improve the Public Service Loan Forgiveness program, simplify income-driven repayment plans, revamp the Borrower Defense to Repayment program for borrowers defrauded by their schools, reform the bankruptcy code to allow student loan discharges, and enact private student loan relief. Comprehensive student loan reform to address all of these issues at once, in addition to broad student loan forgiveness, could be a more feasible route for lawmakers to tackle student debt.</p><h2>Student Loan Forgiveness May Have Difficulty Passing Congress</h2><p>While the White House can propose a budget, it is ultimately up to Congress to write a budget and pass it. And the chances of student loan forgiveness legislation succeeding in both the House and the Senate is uncertain. </p><p>Earlier this week, Senator Joe Manchin (D-WV) indicated that under no circumstances would he weaken or eliminate the Senate filibuster — a procedural tool that allows the minority party to block most legislation by effectively imposing a 60-vote supermajority requirement to end debate. Democrats hold a razor-thin 50-50 majority in the Senate (Vice President Kamala Harris would break any ties), meaning most legislation would require that 10 Republican senators join with Democrats to advance most legislation. </p><p>But hardly any Republican senators — let alone 10, the number required to overcome an expected filibuster — have expressed support for widespread student loan forgiveness. And with Manchin’s recent comments this week, filibuster reform now appears less likely. Thus, barring a seismic shift in policy positions, the chances of student loan forgiveness legislation passing the Senate remain quite low. Given the importance of Congress passing a bipartisan budget, the White House may have concluded that including student loan forgiveness in its budget proposal would have been a non-starter. </p><h2>Biden Is Considering Executive Action to Enact Student Loan Forgiveness</h2><p>Student loan borrower advocates and progressives continue to press Biden to bypass Congress altogether and enact widespread student loan forgiveness through executive action. And they are pushing Biden to go further and cancel $50,000 or more in student loan debt for every borrower.</p><p>Biden has been resistant to using executive authority, and has expressed opposition to $50,000 in student loan forgiveness. But the administration is considering its options. Last week, the Biden administration announced that attorneys under Education Secretary Miguel Cardona will be exploring potential legal authorities that could be the basis for widespread student loan forgiveness implemented through executive action. The Department of Education will coordinate its efforts with the U.S. Department of Justice, which is also reviewing possible legal avenues for student loan forgiveness using executive authority.
